Terms of Service for Catalogo

1. Acceptance of Terms

By accessing or using the Catalogo website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Catalogo is a SaaS platform that allows users to create product listings, upload images, and generate new images using Artificial Intelligence (specifically, Google Gemini).

3. Accounts

  • Registration: You must provide accurate and complete information when creating an account.
  • Security: You are responsible for maintaining the security of your password and accept responsibility for all activities that occur under your account.

4. User-Generated Content and AI Usage

A. User Uploads

You retain all ownership rights to the images and text ("User Content") you upload to Catalogo. However, by uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduction, and modify such content solely for the purpose of operating the Service (e.g., displaying it to you, sending it to the AI model for processing).

B. AI-Generated Images

  • Service Function: The Service utilizes the Google Gemini API to generate images.
  • Ownership: Subject to Google's terms and applicable law, you own the images you generate using the Service. Catalogo assigns to you all of its right, title, and interest in and to the output generated for you by the AI.
  • Disclaimer: You acknowledge that AI generation is probabilistic and may produce inaccurate, offensive, or bizarre results. Catalogo does not guarantee the quality, accuracy, or uniqueness of generated images.

C. Prohibited Content

You may not use the Service to upload, generate, or share content that:

  • Is illegal, pornographic, violent, or promotes hate speech.
  • Infringes on the intellectual property rights of others.
  • Violates the usage policies of our AI provider (Google Gemini).

We reserve the right to remove any content and ban users who violate these rules.

5. Payments and Refunds

  • Payment Processing: All payments are processed through Stripe. We do not store your credit card details.
  • Subscriptions/Credits: Services are billed on a monthly subscription basis with additional credits available for purchase.
  • Refunds: Payments are non-refundable except as required by law.
